Tara Brennan is a litigation associate in the firm’s Washington, DC office. As a member of the firm’s insurance practice group, Ms. Brennan represents and counsels corporate policyholders in a variety of industries, including financial services, technology, and mortgage services, in nationwide insurance coverage disputes. Ms. Brennan has particular experience obtaining coverage for crime losses under fidelity and financial institution bonds and for losses arising under a broad range of other insurance forms including professional liability, directors and officers liability, cyber liability, and commercial general liability policies.

  • Litigated coverage for Freddie Mac under a Financial Institution Bond for a $100 million plus fraud loss arising out of one of the largest-ever financial frauds.
  • Litigated and resolved multiple crime losses under fidelity and financial institution bonds, including claims arising from various Ponzi schemes, major forgery loss, employee theft, and other financial frauds.
  • Pursuing coverage for large mortgage industry company related to first ever challenge to a CFPB administrative action and Director’s enforcement ruling.
  • Litigating coverage for a significant professional liability claim arising from a legacy business for a multi-national technology company.
  • Pursuing D&O coverage for various corporate policyholders regarding regulatory investigations, shareholder derivative suits, securities actions, and related proceedings.
  • Secured coverage under traditional and cyber-insurance policies for a purported class action involving the use of consumer data for a publicly traded technology company.
  • Litigated coverage for third party’s claim of property damage caused by destruction of the policyholder’s hotel on 9/11.
  • Litigated and resolved various first-party property and business interruption claims involving extensive water and mold damage.
  • Represented political club before the U.S. Court of Appeals for the D.C. Circuit regarding former employee’s discrimination claims.
  • Represented defense contractor before the U.S. Court of Appeals for the Eleventh Circuit and district court regarding former employee’s claims of RICO violations and other federal and state law violations.
  • Represented financial institution in post-trial briefing regarding defamation claim arising from former employees’ termination.
  • Represented government contractor regarding former employee’s claim of wrongful discharge under the False Claims Act.

Pro Bono

  • Represented corporate political action committee (“PAC”) and its connected corporation before the U.S. Court of Appeals for the D.C. Circuit regarding campaign finance restrictions and corporate speech rights.
  • Represented taxi drivers’ before the U.S. Court of Appeals for the Third Circuit seeking damages for claims of wrongful detention and violation of their Fourth Amendment rights by Immigration and Customs Enforcement (“ICE”) agents.
  • Represented beneficiary of Federal Employee Health Benefits before the U.S. Court of Appeals for the D.C. Circuit regarding claims that the Office of Personnel Management failed to secure adequate insurance coverage for speech generating devices.
  • Filed amicus curiae brief for criminal law professors in Riley v. California.
  • Represented prisoner on Alabama death row in his federal habeas corpus proceedings.
