As a member of the firm’s anti-corruption and white collar practice groups, Jessica Arco represents corporations and individuals in cross-border internal and government investigations involving allegations of fraud and corruption. A fluent Spanish speaker, Ms. Arco is uniquely equipped to support the needs of clients with operations in Latin America and other Spanish-speaking countries.

Cross-Border Investigations

  • Obtained declination from the DOJ for a Fortune 500 company in a criminal False Claims Act investigation.
  • Conducting internal investigations for Fortune 500 companies related to anti-corruption issues.
  • Advising Argentine national in DOJ and SEC investigations into possible violations of the FCPA.
  • Conducting internal investigation of whistleblower allegations of wire fraud against consumer product manufacturer.
  • Represented Latin-American company in bank fraud investigation by the DOJ.

Anti-Corruption Compliance

  • Performed anti-corruption compliance program assessments and recommended program enhancements for several life sciences companies.
  • Developed anti-corruption policies, procedures, and training presentations in Spanish and English tailored to mining and pharmaceutical clients’ operations in Latin America and elsewhere.
  • Regularly advises clients in a diverse range of industries, including life sciences, consumer products, technology, extractive, and financial services, on anti-corruption issues, such as designing criteria and procedures for third party due diligence.
  • Conducted anti-corruption due diligence for potential acquisitions and other investment transactions by life sciences and financial services companies.

Pro Bono

  • Successfully represented undocumented agricultural workers in litigation involving human trafficking, Fair Labor Standards Act (“FLSA”), Migrant and Seasonal Agricultural Protection Act (“MSPA”), and various tort claims.
  • Successfully represented an individual convicted of murder and robbery in habeas corpus and subsequent pretrial proceedings.
  • Represented a non-profit organization in drafting an amicus brief to the Board of Immigration Appeals (“BIA”) discussing asylum claims based on the particular social group composed of an applicant’s family.
  • Representing an attorney in an inquiry before the U.S. Department of Justice, Office of Professional Responsibility.
