Paramount’s Covid Safety Insurance Win Gives Film Industry Hope

Bloomberg Law featured Jeff Kiburtz's commentary about Paramount Global’s recent Covid-19 insurance win against a W.R. Berkley unit, laying out a roadmap for other film and TV production companies seeking reimbursement for pandemic safety costs.

“The Viacom ruling absolutely strengthens entertainment companies’ ongoing negotiations with insurers,” said Jeff.

While most businesses hold commercial policies that cover property damage, TV production insurance is unique in that it also covers injuries to people. In addition, TV production insurance also comes with a “due diligence” clause that requires policyholders to use their best and most practical efforts to avoid production delays and cancellations, Jeff said.
