Federal bid protests are often viewed as a specialized and niche practice. They are litigated in dedicated forums; they involve specific law and procedure; and they move very quickly, often with unforgiving deadlines. While bid protest procedures in certain state and local jurisdictions may resemble federal practice, the federal system may still seem challenging to navigate. In this breakout session, we will discuss some of the unique aspects of federal bid protests as compared to state and local protests. This session will be useful for those hoping to learn more about how federal bid protests work, and also for those who may be looking to borrow certain aspects of federal practice and apply them in their state and local practice. This Panel will discuss specific topics related to filing and prosecuting federal bid protests, including:

  • Multiple dedicated protest forums
  • Timeliness rules and stays/preliminary injunctions
  • Pre-award protests
  • Debriefings
  • Protective orders
  • Voluntary corrective action
  • Document production
  • Supplemental protests
  • Available relief and “appeals”
