Aseem Padukone is a civil and criminal litigator who has represented clients at the trial and appellate level. Mr. Padukone represents clients across a wide array of industries in complex commercial litigation matters and white collar investigations. He also has advised multiple clients responding to government subpoenas. Mr. Padukone maintains an active pro bono practice, and has secured trial and appellate victories while serving as lead counsel.

  • Representing an international marketer and distributor of agricultural products in commercial litigation involving allegations of fraud, misrepresentation, and RICO conspiracy.
  • Representing a pharmaceutical distributor in multi-district litigation involving several tort allegations.
  • Represented Chiquita Brands in mass tort proceedings arising out of extortion payments made by Chiquita’s former subsidiary to armed groups in Colombia.

White Collar Defense and Internal Investigations

  • Representing major technology companies in connection with investigations conducted by multiple federal and state law enforcement agencies.
  • Representing a defense contractor in a DOJ criminal export controls and fraud investigation.
  • Represented a Special Committee of the board of directors of a technology company in an internal investigation involving allegations of a dysfunctional workplace culture and ineffective internal controls.

Pro Bono

  • Served as court-appointed counsel of record and presented oral argument in an appeal seeking to overturn the district court’s dismissal of a Section 1983 civil rights action on the basis of a failure to exhaust administrative remedies. The Ninth Circuit unanimously ruled to reverse the district court’s order. Todd v. Johnson, No. 15-16756 (9th Cir.).
  • Served as lead counsel and secured acquittal following a three day criminal trial. People v. McGrath (Marin Sup. Ct.).
  • Represented an incarcerated prisoner in federal district court in a lawsuit concerning allegations of excessive force. Gooden v. Baptista, Case No. 13-0352 (N.D. Cal).
  • Represented domestic violence victim who was falsely accused of elder abuse by her spouse. The Santa Clara County District Attorney’s Office declined to press charges.
