2016年4月18日,最高人民法院和最高人民检察院发布司法解释(“司法解释”)对中国刑法在贿赂腐败犯罪中的适用原则进行了规定。该司法解释为理解2015年生效的《刑法修正案(九)》提供了额外的指引。其中,特别值得注意的是该司法解释:(1)扩展了贿赂财物的范围以涵盖无形的财产性利益;(2)规定了在为他人提供利益之事后收受的财物依旧被认定为贿赂;(3)重新明确并提高了贿赂犯罪的定罪量刑标准,且对国家工作人员贿赂犯罪与非国家工作人员贿赂犯罪适用不同的定罪量刑标准;与(4)明确了自首及获取从轻减轻免除处罚的具体要求.
