Ted Karch advises clients in a range of industries on the legal and reputational risks inherent in today’s data-driven world. His practice involves advising on US federal and state data privacy and cybersecurity laws as well as international privacy rules, including the EU General Data Protection Regulation (GDPR) and China’s Cybersecurity Law.

Mr. Karch helps clients navigate issues that arise in developing and launching innovative products. He has advised clients on practical solutions for approaching issues implicated by laws involving biometric data, online behavioral advertising, geolocation information, genetic privacy, children’s privacy, student privacy, and unfair and deceptive practices. This advice often spans multiple jurisdictions, including the US, the EU, and China, among others.

In addition, Mr. Karch advises clients in managing their intellectual property portfolio, especially copyright and trademark assets.

  • Advised clients (inside and outside of the EU) on developing strategies for approaching GDPR compliance and implementing those strategies.
  • Advised financial services client on novel issues of Chinese privacy and security law, including preparing a security self-assessment of cross-border data transfers for consultation with Chinese regulators.
  • Performed due diligence on the privacy and cybersecurity practices of an artificial intelligence company targeted for potential acquisition.
  • Assisted a leading pharmaceutical company in developing a digital advertising strategy that fulfilled its obligations under federal and state privacy law, as well as self-regulatory regimes.
  • Aided client in drafting privacy and security provisions of agreement for software development of mobile application analyzing health information.
  • Advised a major technology company on potential copyright issues involved in a live-streaming service offering.
  • Advised media service provider on copyright and trademark risks involved in production of a well-known television show.
