Brianne Bharkhda

Brianne Bharkhda represents a variety of clients in high-stakes patent litigation and commercial disputes. She has particular expertise in complex pharmaceutical patent litigation, and has litigated numerous cases involving generic drug approvals and the Hatch-Waxman Act. She has extensive experience representing clients at all stages of litigation, from case inception through trial and appeal. A skilled trial lawyer, Brianne has had prominent roles trying patent cases before both judges and juries.

Brianne is a tenacious advocate with a record of achieving favorable results for her clients. Her recent trial experience includes major roles in bench trials in the District of Delaware in multi-defendant Hatch-Waxman patent cases. She has argued and appeared as lead counsel before the Federal Circuit. Her courtroom experience also includes arguing motions and claim construction in the nation’s most active patent litigation jurisdictions.

Brianne has deep substantive knowledge of the law, and navigates difficult and novel legal issues with creativity. In each case, she focuses on building and presenting a clear and persuasive factual record. Clients look to her to handle their most challenging cases. Brianne has represented clients in litigation matters involving an array of technology areas, including pharmaceuticals, medical devices, mechanical devices, and electronics.

Brianne was recognized as a 2022 Law360 Rising Star in Intellectual Property. She was named an Intellectual Property Litigation "Rising Star" by Washington DC Super Lawyers for five consecutive years (2015-2020).

Brianne’s past pro bono work includes representing indigent clients in family court, landlord/tenant disputes, and public benefits appeals.
