Bart Van Vooren is quoted in PaRR's "Brexit Club" column regarding the two-part approach to the Brexit negotiation process, following the publication of draft negotiating directives for “phase one” of the talks. According to Van Vooren, there are real legal problems with this two-part approach, regardless of the parties' up-front negotiating positions. One problem he sees is that the European Commission is requiring as part of its phase one negotiations for the UK to make decisions on the extent it will be bound by the European courts in Luxemburg. Those decisions will have set a major precedent for the phase two negotiations. Van Vooren points to the example of medical devices, a sector which will be transitioning from an old EU directive to a new EU regulation over the time of Brexit, and one that could be dangerously impacted.
