High Court Answers Sought On Human Trafficking, Agency Power

September 19, 2017, BNA's Federal Contracts Report

Justin Ganderson is quoted in a Federal Contracts Report article regarding government contracts petitions seeking review from the Supreme Court. Commenting on Rothe Development Inc.'s petition seeking review of the constitutionality of the Small Business Administration's 8(a) program, Ganderson says, challenges to the 8(a) program may not end if the court passes on this case. Rothe or another plaintiff could challenge the constitutionality of the 8(a) program’s implementing regulations, an issue Rothe didn’t raise with the D.C. Circuit, he adds.
