ACI 13th Annual Paragraph IV Disputes Conference

The ACI 13th Annual Paragraph IV Disputes Conference take place on April 29-30, 2019 in New York, NY. On April 30th, Covington's Scott Kamholz, a former Administrative Patent Judge ("APJ") at the PTAB ("Patent Trial and Appeal Board"), will moderate "The PTAB Live! Practice, Policy, and Procedure in the World of Pharmaceutical Validity Challenges" panel featuring three current PTAB APJs: Deputy Chief Judge Jacqueline Wright Bonilla, Lead Judge Michelle N. Ankenbrand, and Judge Rama G. Elluru. They will discuss:

  • Recent trends in biopharma cases at the PTAB;
  • The emergence of post-grant review and key differences from inter partes review;
  • Impact of new PTAB precedent on life science cases;
  • Practice tips on obtaining/avoiding discretionary denial of institution;
  • How the PTAB handles remands; and
  • Initial impressions of the motion to Amend pilot program.

Dr. Kamholz served as an APJ at the PTAB from 2012 - 2015. During that time, he wrote many widely cited opinions that established basic principles for PTAB proceedings, mentored numerous other judges, and spoke extensively on AIA trial procedures.
