Kathryn Arnold’s litigation practice focuses on representing corporate clients in white-collar defense and complex civil matters.

Ms. Arnold represents pharmaceutical companies, biotechs, medical device companies, defense contractors, financial institutions and other clients in government and internal investigations.  She has represented clients before the Securities and Exchange Commission, the Department of Justice, the Department of Health and Human Services - Office of Investigations, and other government entities.

Ms. Arnold has extensive experience representing life sciences companies in government investigations involving alleged violations of the Food, Drug and Cosmetic Act, the Anti-Kickack Statute, the False Claims Act, and other federal statutes, as well as in defending related False Claims Act litigation in federal courts across the country.  She also conducts internal corporate investigations, as well as advises clients on compliance issues and risk mitigation.  Ms. Arnold has significant experience with ediscovery, and regularly counsels clients on complex ediscovery issues and related cost management.

Representative Matters

Government and Other Investigations:

  • Represented biotechnology, pharmaceutical and medical device companies in federal government investigations of sales and marketing practices resulting in civil and criminal declinations.
  • Conducted internal investigation for pharmaceutical company involving anti-kickback statute compliance in connection with a pending criminal investigation.
  • Represented pharmaceutical company in internal investigation involving alleged improprieties related to internal controls and good manufacturing practices.
  • Represented national defense contractor in an internal investigation and related federal criminal investigations involving conflict of interest issues and alleged improprieties regarding billion-dollar defense procurements. 
  • Represented Board of Directors in an internal investigation of stock options practices.
  • Conducted internal investigations for pharmaceutical company involving intellectual property issues arising out of contractual obligations.

Complex Commercial Litigation:

  • Represented Irish company before the U.S. District Court for the District of Columbia in a favorably settled internet domain dispute involving complex procedural and novel legal issues implicating internet auctions.
  • Obtained confirmation of an AAA Arbitration Panel decision in a successful defense of an international automobile company in appellate proceedings before the U.S. Court of Appeals for the Third Circuit.
  • Served as counsel to trade associations in copyright infringement dispute before the U.S. District Court for the Southern District of Florida, including assisting with negotiating the then largest attorney’s fee award under The Copyright Act.
  • Represented global investment bank in successful appeal to the U.S. Court of Appeals for the Eleventh Circuit in action involving Truth in Lending Act and related claims.
  • Assisted Fortune 500 technology corporation in multi-million dollar sanctions proceedings before the U.S. District Court for the Southern District of California and obtained $9.3 million fee award.
  • Represented international retail company in successfully settled contract dispute before the Massachusetts District Court.

Pro Bono

Ms. Arnold maintains an active pro bono practice and has devoted significant time over the years to assisting clients resolve both civil and criminal matters.

  • Favorably resolved multiple insurance claims prior to filing suit in the Superior Court for the District of Columbia for breach of contract and related tort claims.
  • Obtained partial reversal of criminal conviction through appeal to the Maryland Court of Special Appeals.
  • Successful settlement of contract claim pending against an individual before the District Court of Maryland.
