Tom Hogan has extensive experience litigating cases involving environmental contamination and advises clients on environmental issues in connection with corporate transactions and regulatory compliance.  Mr. Hogan also litigates insurance coverage disputes.

Representative Matters

  • Advised numerous clients in connection with environmental liabilities associated with acquisitions and divestitures of businesses and assets and negotiated contractual provisions to address these liabilities.
  • Represents a successor to a mining company in a multi-plaintiff, toxic-tort lawsuit in connection with a CERCLA site in Idaho.
  • Represents a global defense and technology company in a CERCLA action related to historic contamination at a public park in New York.
  • Represents a chemicals manufacture in litigation regarding historic contamination of a major river in New Jersey.
  • Defended a global defense and technology company against CERCLA, breach of contract, and fraud claims related to the sale of industrial property in Connecticut, securing dismissal.
  • Prosecuted a CERCLA lawsuit against the federal government on behalf of a chemical products manufacturer, obtaining contribution to remediation costs.
  • Litigated to settlement on the eve of trial an environmental insurance coverage action regarding groundwater contamination in Southern California.
  • Litigated defense coverage for a broadcaster in connection mass-tort claims stemming from a fatal nightclub fire.
  • Represented the successor to a mining company in environmental insurance coverage litigation, securing a favorable settlement.
  • Represents a hospital seeking coverage for more than 100 claims alleging abuse by a former staff physician.

Pro Bono

  • Filed amicus curiae brief in a defamation case before the Inter-American Commission on Human Rights, opposing criminal punishment for speech on environmental matters.
  • Litigated a personal injury action alleging excessive use of force against a special-needs child by a public school official, obtaining a favorable settlement on the eve of trial.
  • Obtained a settlement for a job applicant in an age discrimination case against a university.
