Scott Schrader handles patent litigation and other intellectual property matters and complex civil disputes.  Mr. Schrader’s intellectual property matters have involved digital subscriber line technology, pharmaceuticals and pharmaceutical dispensing systems, food products, electronic design automation, interactive television, internet content delivery services, semiconductor testing platforms and other technologies.  He has also handled shareholder derivative actions, securities litigation, environmental insurance coverage claims and lender liability claims, as well as disputes over license agreements, lease agreements, credit agreements and letters of credit, and he has also defended numerous individuals and institutions in regulatory and criminal enforcement proceedings.  Mr. Schrader frequently counsels clients on intellectual property issues in connection with transactions or contemplated new business ventures.  Before becoming a lawyer, Mr. Schrader worked for five years as an electrical engineer designing components for radio frequency ("RF") receiver systems.  One of his designs, a low noise amplifier module, won a company award for design excellence. 

Representative Matters

  • Represented a DSL (digital subscriber line) component manufacturer in litigation and trial in a dispute involving patent infringement and antitrust claims relating to several DSL patents and DSL industry standards. 
  • Defended a food manufacturer in litigation and trial in a patent infringement dispute relating to a dual-textured pet treat. 
  • Defended a fiber-optic telecommunications network provider in a shareholder dispute involving misrepresentation and related claims in connection with early-round investments in the company.  
  • Represented a provider of middleware and server software for cable TV systems in a patent infringement action relating to technology for distributing and processing television programming and associated interactive content.

Pro Bono

  • First chair defense of criminal case in Superior Court of California, Marin County. After two-day trial, secured "not guilty" verdict on all counts.
