Shannon Nestor is an associate in the firm's intellectual property and insurance litigation practice groups. Her intellectual property practice focuses on patent, copyright, trademark, and Internet-related matters, and she has represented clients at the International Trade Commission, World Intellectual Property Organization, and the Trademark Trial and Appeal Board. In her insurance practice, Ms. Nestor has represented policy holders in federal and state court, as well as in arbitration, and she has experience representing clients at the ICC International Court of Arbitration, the National Arbitration Forum, and the American Arbitration Association.
Representative Matters
- Representing policy holder in product liability coverage arbitration and litigation.
- Represented Samsung Electronics Co., Ltd. and other respondents in patent litigation involving MLC NAND Flash memory. In re Certain MLC Flash Memory Devices and Products Containing Same, ITC Inv. No. 337-TA-683.
- Represented The American Automobile Association, Inc. in numerous trademark enforcement proceedings before the World Intellectual Property Organization and the National Arbitration Forum.
- Represented one of the nation's leading financial institutions against multi-billion dollar antitrust claim in American Express Travel Related Services, Inc. v. Visa U.S.A., Inc., No. 04-8967 (S.D.N.Y. 2004).
- Defended a financial services organization in trademark cancellation and opposition proceedings before the Trademark Trial and Appeal Board, resulting in dismissal of the proceedings.
