Richard Rainey is a partner in the Intellectual Property Litigation Group in the firm's Washington, DC office.
Mr. Rainey is a trial and appellate litigator who has resolved a wide range of intellectual property matters for clients in the software, electronics, financial services, internet, pharmaceutical, semiconductor, telecommunications, automotive, oil and gas, textile, and industrial chemicals industries. In addition to litigation, his practice includes intellectual property counseling and patent prosecution.
Mr. Rainey's clients have included Samsung Electronics Co., Ltd., Microsoft, Juniper Networks, Thomson Reuters, DeMonte Fabricating Ltd., ASML, InnoLux, GlaxoSmithKline, Gannett, JPMorganChase, PhRMA, and Promontory Interfinancial Network.
Mr. Rainey has extensive jury and non-jury trial experience in patent cases. He has also been counsel in more than 40 appeals in patent cases to the United States Court of Appeals for the Federal Circuit and has argued numerous times before that Court. Most recently, as lead appellate counsel, Mr. Rainey obtained reversal of an $85 million judgment and permanent injunction against Thomson Reuters and iDeal. See MuniAuction, Inc. v. - Representing Samsung Electronics in a patent infringement action in the Eastern District of Texas involving DLP televisions. Cheetah Omni LLC v. Samsung Electronics, (E.D. Tex.).
- Representing Nintendo in a patent infringement action at the ITC brought by Hillcrest involving Nintendo’s Wii game system. In re Certain Video Game Machines and Related Three-Dimensional Pointing Devices, Inv. No. 337-TA-658.
- Represented Samsung Electronics in a patent infringement action at the ITC brought by Prof. Rothschild involving the manufacture of LEDs and LDs. In re Certain Short-Wavelength Light Emitting Diodes, Laser Diodes and Products Containing Same, Inv. No. 337-TA-640.
- Representing Samsung Electronics in a patent infringement case in the Southern District of New York brought by Genoa Color Technologies involving flat-panel televisions. Genoa Color Tech., Ltd. v. Samsung Elec. Co., Ltd., et al. (S.D.N.Y.).
- Representing DeMonte Fabricating in a Federal Circuit appeal from an adverse judgment and permanent injunction in a patent case involving segmented truck covers. Sundance v. DeMonte Fabricating, et al., (Fed. Cir.).
- Successfully represented Thomson Reuters and i-Deal LLC before the Federal Circuit obtaining reversal of an $85 million judgment and permanent injunction in a patent case involving electronic municipal bond auctions. MuniAuction, Inc. v. Thomson Corp., et al., 532 F.3d 1318 (Fed. Cir. July 14, 2008).
- Successfully represented InnoLux Display Corp. in a patent infringement action brought by Guardian Industries Corp. in the District of Delaware in a case involving LCD technology.
- Representing Microsoft in a patent infringement case in the Eastern District of Texas brought by Charles E. Hill involving e-commerce web sites. Charles E. Hill & Assoc. v. Microsoft et al., (E.D. Tex.).
