Richard F. Kingham

Richard Kingham is a partner assigned to the Washington and London offices who concentrates on food and drug law, European Community law, product liability and product safety.  He has acted for most of the major pharmaceutical manufacturers and biotechnology companies in the United States and Europe, as well as trade associations such as the Pharmaceutical Research and Manufacturers of America (PhRMA), the Consumer Healthcare Products Association (CHPA), and the National Pharmaceutical Council.

Representative Matters

• Represented pharmaceutical manufacturers in administrative investigations, criminal prosecutions, and product liability litigation relating to alleged safety-reporting deficiencies in the United States and Europe.
• Acted for vaccine manufacturers in connection with each of the major federal and state enactments relating to liability and compensation for vaccine-related injuries, including the swine flu legislation in 1976, the childhood vaccine injury compensation legislation in 1986, the PREP Act in 2005, and state laws in New Jersey, Ohio, and other jurisdictions.
• Coordinated the successful defense of the first judicial challenge to the grant of a marketing authorization in the EU centralized procedure.
• Acted for a US medical device manufacturer in successful litigation in the English High Court to enjoin publication of adverse publicity by the UK Medical Devices Agency.
