In the communications and media area, our representation of leading trade associations in the broadcast, electronic entertainment, and other areas has kept us at the center of the most important, groundbreaking developments that these industries face.
Covington brings a multi-disciplinary and holistic approach to our industry representations, including legislative and regulatory advocacy, commercial and tax issues, trial and appellate litigation, media and public relations strategy, and cross-industry initiatives. Covington also has extensive experience with organizing and representing ad-hoc coalitions within an industry that are developed to pursue a single issue. Such coalitions have been developed with respect to issues such as the digital television transition, broadband, and telecommunications.
Representative Matters
- On behalf of MSTV, representing the television industry on key legislative, FCC and industry issues, including, for example, negotiating a template agreement with Sprint Nextel for the migration of broadcast ENG services out of the 2 GHz spectrum, the implementation of a “hard date” for the transition to a digital-only television service, and for the process of electing and assigning final DTV channels.
- Waging on behalf of the Network Affiliated Stations Alliance and the National Association of Broadcasters a multi-year, multi-venue battle before Congress, the FCC, and the Third and D.C. Circuits Courts of Appeals on the national television ownership rule, successfully achieving a legislative reversal of the FCC’s decision.
- Office of Communication of the United Church of Christ Inc., v. FCC (D.C. Cir. 2003): Successfully representing the Association of Public Television Stations on whether public television stations may use their surplus digital capacity for commercial purposes, including non-broadcast advertisements.
- Representing the NBC Television Affiliates on the formation and implementation of a joint venture with NBC Universal to create WeatherPlus, a national all-weather digital television network.
