Investigation and prosecution of cartel activity continues to be a focal point for the U.S. Department of Justice Antitrust Division and foreign competition authorities. The explosive growth in the detection and pursuit of cartels has been fueled by the proliferation of amnesty and leniency programs worldwide. In addition, private plaintiffs from the US and abroad have been increasingly aggressive in seeking treble damages for alleged collusive activities.
Covington has extensive experience in managing these challenges, including developing preventative compliance programs, conducting internal investigations, managing US grand jury and foreign competition authority inquiries, securing amnesty or leniency for our clients under US and foreign programs (including those of the EU and Canada), and defending cartel-related direct and indirect purchaser actions and securities suits in federal and state courts. Covington’s international presence also makes it well situated to provide a coordinated response to the demands of investigations in multiple jurisdictions.
Our cartel practice draws upon the strengths of both our premier antitrust and white collar practice groups. Our antitrust practice includes alumni of both the DOJ and FTC, as well as other relevant Executive Branch agencies, and those with extensive experience in handling cartel and international antitrust matters in private practice. Members of our white collar practice with experience in cartel matters include a former Deputy Associate Attorney General in the DOJ and former senior prosecutors in U.S. Attorneys’ Offices.
The firm has represented clients in criminal investigations in a multitude of industries including chemicals, computer hardware, state government contract bidding, billboard advertising, concrete, extractive industries, food supplements, telecommunications, and milk contracts.
Representative Matters
- Represented one of the largest providers of telecommunications services in Asia in a DOJ investigation of alleged collusion with respect to termination rates charged to US carriers. The government ultimately closed the investigation and took no action against our client.
- Representing a leading global producer of rubber chemicals in connection with US, European, and Canadian investigations and related antitrust and securities litigation.
- Representing one of the world’s leading oil companies in an EU cartel investigation into the bitumen market.
- Representing a major US producer of chemicals in a price-fixing investigation by the DOJ.
- Represented a manufacturer of consumer health products in a DOJ investigation of collusion concerning broker fees and related antitrust litigation. The investigation was closed with no action taken against our client.
