Covington represents international and domestic clients in proceedings arising under the US trade laws, including the antidumping and countervailing duty laws, Sections 201 and 301 of the Trade Act of 1974, and the Generalized System of Preferences.  Through our Brussels office, we also represent clients in antidumping and other trade law proceedings before the EU and EU Member States.  We also assist US and other multinational corporations involved in antidumping and other trade proceedings in countries in Asia and South America.  In addition, we represent clients in dispute-settlement proceedings arising under NAFTA and the WTO Dispute Settlement Understanding.

Covington's experience in the trade area extends back to the 1930s, and we have been involved in many of the important trade cases that have been brought in the intervening years.  During this long history, we have assisted dozens of private companies and a number of governmental entities in successfully navigating the US trade laws, including antidumping and countervailing duty investigations and Sections 201 “escape clause” proceedings.  We have also represented clients in Section 301 proceedings (authorizing retaliation against foreign countries that restrict access to their markets) and proceedings before the USTR concerning the Generalized System of Preferences (GSP).

In addition, we have significant experience in dispute-settlement proceedings arising under NAFTA and the WTO Dispute Settlement Understanding.

  • Low enriched uranium antidumping and countervailing duty proceedings (on behalf of Electricité de France).
  • Stainless steel bar antidumping and countervailing duty proceedings (on behalf of Foroni S.p.A.).
  • Off the road tires antidumping and countervailing duty proceedings (on behalf of The Goodyear Tire Company).
  • Electrolytic Manganese Dioxide (EMD) antidumping proceedings (on behalf of Duracell).
  • Wooden bedroom furniture antidumping proceeding (on behalf of Dalian Huafeng Furniture Co., Ltd.).
  • EU countervailing duties on DRAMs from Korea (representing the Council of the European Union in case lodged by Hynix in the European Court of First Instance and assisting the European Commission in the WTO proceedings initiated by Korea).
