Covington has a longstanding, highly successful appellate litigation practice that extends to our patent litigation practice.  The firm’s appellate practice includes 60 specialists and boats 16 former U.S. Supreme Court clerks and six alumni of the solicitor general’s office.  Our attorneys have handled more than 50 cases before the Supreme Court and hundreds in state and federal appeals courts.  Indeed, Covington has been named to The National Law Journal’s Appellate Hot List in both 2008 and 2009, as having one of the top appellate practices in the country.

Our patent litigation practice has a track record of obtaining favorable results for our clients on patent cases before the Federal Circuit, and is regularly asked to represent clients on appeal after a lower court has entered an adverse ruling.

Representative Matters

  • Representation of Thomson Corporation and i-Deal in obtaining the reversal of an $85 million judgment and permanent injunction in a patent case involving electronic municipal bond auctions.  MuniAuction, Inc. v. Thomson Corp., et al. (Fed. Cir.).
  • Representation of the University of Pittsburgh in vacating the dismissal of a patent case involving apparatus for use in radiation therapy of lung cancer patients.  The case was remanded for further proceedings.  University of Pittsburgh v. Varian Medical Systems, Inc. (Fed. Cir.).
  • Representation of Beyond Innovation Technology in overturning a verdict of infringement of three patents asserted against inverter controllers used in the backlighting of LCD screens.  O2 Micro International Limited v. Beyond Innovation Technology Co., Ltd., et al. (Fed. Cir.).
  • Representation of DeMonte Fabricating in obtaining the reversal of an adverse judgment and permanent injunction, and the denial of rehearing in a patent case involving segmented truck covers.  Sundance v. DeMonte Fabricating, et al. (Fed. Cir.).
  • Represented Juniper Networks obtaining affirmance of a judgment of non-infringement in a patent case involving the transmission of data among network routers.  Toshiba Corp. v. Juniper Networks, Inc. (Fed. Cir.).
