The firm has achieved unparalleled success before the Court of Federal Claims, the DC-based court that handles non-tort money damages claims against the United States government.  We have obtained for our clients over $1.8 billion in judgments and settlements over the last few years, which we believe exceeds the amount secured by any other firm.

Court of Federal Claims litigation encompasses both breach of contract and Fifth Amendment takings claims, and we have tried to completion both kinds of cases.  The firm brings to the table both seasoned courtroom litigators and extensive substantive expertise, whether the subject matter is oil and gas development or low income housing programs.  Besides achieving success at the Court of Federal Claims level, we have also successfully represented our clients in defending their judgments on appeal to the Federal Circuit and the United States Supreme Court. 

Representative Matters

Our successful clients have included:

  • A coalition of eleven oil and gas companies whose efforts to pursue development of their California offshore oil and gas leases were thwarted by the federal government.
  • Other oil companies, including Exxon Mobil, Shell, Chevron, in breach of contract lawsuits involving leases offshore Alaska, Florida and North Carolina.
  • A developer of low income housing, in connection with the government’s failure to provide benefits promised by the Department of Housing and Urban Development.
  • A uranium mining company, United Nuclear, on whose behalf we demonstrated that the United States’ activities interfering with its leases on Indian lands constituted a regulatory taking. 
  • Kerr-McGee, in connection with phosphate leases on a Florida national forest.
