Government Affairs

Covington represents numerous corporate, trade association, and nonconnected PACs.  We advise on the benefits and disadvantages of PACs, optimal PAC structures and governance issues, and FEC compliance and reporting.

For corporations particularly, a political action committee, or “PAC,” offers a legally compliant vehicle for channeling political activity.  Because the rules governing PACs are relatively clear and well-developed, PACs often offer a way to reduce the compliance risks associated with corporate involvement in political fundraising.  Covington has established many PACs for our clients, and our clients often look to our Election and Political Law Practice Group to provide ongoing compliance advice concerning their PACs day-to-day operations.  We provide a highly responsive point-of-contact for PAC managers and administrators to answer questions concerning the solicitation and handling of contributions, fundraising strategies, and reporting.  We understand the need for fast answers, especially when reporting deadlines are looming.

Services we typically provide to PACs include:
  • Drafting and updating of PAC Bylaws.
  • Advice concerning governance and internal controls.
  • Training of PAC Boards and PAC officers.
  • Training of PAC fundraising agents.
  • Drafting a PAC Compliance Manual and corporate policies governing the PAC.
  • Routine review of all PAC communications and solicitations.
  • Preparation or review of PAC brochures and annual reports.
  • Oversight of internal annual or bi-annual PAC audits.
  • Assistance with responding to inquiries or requests for additional information from the FEC.
  • Review of FEC reports.
