We frequently appear before the Federal Election Commission to defend clients against FEC enforcement actions, and the firm is a well-known and respected player in FEC proceedings.  Our practice group includes a former Chairman of the FEC, and numerous other lawyers who have litigated cases before the FEC.  We draw on our extensive FEC regulatory experience to develop novel legal theories to obtain dismissals.  At the same time, we have the resources and specialized expertise to decisively litigate FEC cases through the entire enforcement process and in U.S. District Court.

It is remarkably easy for a business competitor, political opponent, or advocacy organization to file an FEC complaint against you and to draw you into a full-blown FEC investigation.  Often such investigations are prompted by an adverse news story, by a disgruntled former employee, or by problems arising from operation of a political committee or PAC.  The FEC’s administrative enforcement process is arcane and relatively devoid of the usual due process protections to which most corporations are accustomed. 

Our Election and Political Law Practice Group regularly represents corporations, corporate officers, political parties, PACs, consultants and politically active individuals in FEC investigations, including parallel criminal investigations by the U.S. Department of Justice.

Representative Matters

  • We obtained outright dismissal of FEC complaints filed against Friends of Giuliani Exploratory Committee.
  • We obtained the dismissal of an FEC complaint against a prominent hedge fund manager.
  • We represented BB&T Bank in an FEC investigation that was resolved on favorable terms and with no admission of liability.
