Covington advises clients about their strategic response to FAR and non-FAR based contracting opportunities, often beginning before the release of a formal agency solicitation.   We represent clients in protest litigation and ADR challenging contract award decisions, at the Government Accountability Office ("GAO"), the U.S. Court of Federal Claims, and in agency-level protest proceedings, as well as in contract claims litigation and ADR under the Contract Disputes Act and other disputes resolution systems.  We also provide advice to local government clients about conducting procurements and minimizing the risk of protest litigation.

Representative Matters

  • Three separate protest cases in U.S. Court of Federal Claims on behalf of major developer involved in Military Housing Privatization Initiative competitions, including week-long trial in one matter and negotiation of complex real estate transaction settlements in two matters, teaming with lawyers in our real estate practice.
  • Counseling to life-sciences manufacturer competing for various research and development and supply contracts with HHS, including a multi-year development contract valued at over $200 million.  Project involved extensive teaming with Covington’s food and drug lawyers.
  • Successful representation of US electronics manufacturer in federal trial and appellate courts against contract claims by foreign sovereign government asserting third-party beneficiary rights under Foreign Military Sales contract; case raises issues of first impression under Contract Disputes Act and Arms Export Control Act.
  • Counseling to local government agency about RFP design and contractor selection process, including design scoring, evaluation, selection and debriefing procedures designed to reduce risk of procurement litigation.
  • Pre-RFP through post-debriefing advice to offeror on major TACOM vehicle procurement, resulting in $5 billion multi-year award to client and no protest litigation by competitors.
  • Successful representation of a local government client in an arbitration dispute over the client's contractual obligation to construct a major sports facility.
