Covington represents government contractors of all sizes at the federal and state level in bid protest litigation challenging or defending contract award decisions and in pre-award protest litigation challenging the terms of solicitations. Our attorneys work to tailor the protest strategy to the particular needs and circumstances of their clients. At the federal level, we have substantial experience representing clients at the Government Accountability Office (“GAO”), before the U.S. Court of Federal Claims (“COFC”), and in agency-level protest proceedings. We work with clients to prepare for and assess the results of a debriefing to determine both the likelihood of success and the types of relief available from each protest forum. Given that a number of our attorneys hold government security clearances, we also can represent clients in bid protests involving classified issues. In addition to federal bid protests, we handle bid protests at the state level and advise state and local government agencies about conducting procurements and minimizing the risk of future protest litigation. We also represent clients in size protests before the Small Business Administration (“SBA”).
Representative Matters
- Represented multiple major defense contractors in successful defense of GAO bid protests relating to armored fighter vehicle procurements.
- Represented an international security company in successful prosecution of GAO protest for security services in Iraq.
- Prevailed in multiple GAO bid protests for an international construction company for construction services in Afghanistan.
- Led protest proceedings for a major IT reseller at Court of Federal Claims involving a Department of the Interior enterprise-wide cloud computing procurement.
- Handled three separate protest cases at the Court of Federal Claims on behalf of a major developer involved in Military Housing Privatization Initiative competitions, including week-long trial in one matter and negotiation of complex real estate transaction settlements in two matters, teaming with lawyers in our Real Estate practice.
- Led successful agency level pre-award protest reversing unduly narrow product specifications in the RFP that would have precluded our client’s participation in the procurement opportunity.
- Advised a local government agency about RFP design and contractor selection process, including design scoring, evaluation, selection and debriefing procedures designed to reduce risk of procurement litigation.
- Advised a major defense contractor on protest issues relating to the award of test and simulation services for Missile Defense Agency IDIQ contract.
- Represented a court reporting company in multiple size protests before the Small Business Administration Office of Hearing and Appeals.
- Represented a global technology company in successful protest of commercial-item issues.
