Companies that sell to the U.S. Government are regulated by a complex set of statutes and regulations and often find themselves vulnerable to allegations of fraudulent behavior.  Covington regularly advises clients on how to avoid false statements and claims.  Our lawyers conduct internal investigations as to compliance with the complex statutes and rules that govern public procurement and when issues of fraud commonly arise.  We also advise as to whether clients need to disclose specific types of alleged misconduct to the U.S. Government.  We negotiate with U.S. government enforcement agencies and, if the matter cannot be resolved, represent clients before administrative and judicial tribunals.

Representative Matters

  • Counseled a contractor regarding federal disclosure and certification requirements resulting from initiation of criminal proceedings against the client’s corporate officers in South America and from U.S. indictment of corporate board member.
  • Negotiated a complex settlement of allegations of misrepresentations in engineering services contract to avoid debarment and False Claims Act liability.
  • Investigated and provided advice as to the disclosure of Anti-Kickback Act violations by an employee of a Fortune 50 technology client.
  • Advised a major telecommunications service provider and achieved a favorable settlement in connection with General Services Administration Federal Supply Schedule Price Reduction Clause investigation.
  • Advised a major research university and conducted an internal investigation in connection with qui tam action and subsequent investigation by government enforcement agencies.
  • Advised a large multinational consulting firm in response to the U.S. Government fraud task force investigation into alleged kickback payments to federal consultants for government technology contracts.
  • Successfully defended a NASA contractor in a grand jury investigation into allegations that it had submitted false invoices.
