In collaboration with our extensive practices in other areas, our Public Policy and Government Affairs practice provides health care clients with an interdisciplinary, strategic approach to the most complex and politically charged coverage, reimbursement, and compliance issues.
The Health Care industry is dominated by federal reimbursement programs and vigorous oversight by Congress and the Executive Branch. With the enactment of the Patient Protection and Affordable Care Act (“ACA”), and concerns about the sustainability of health care programs and federal and state budgets, the Medicare and Medicaid programs will continue to be the focus of much regulatory and legislative attention. And the business activities of stakeholders in the health care industry will continue to be heavily scrutinized.
Our Public Policy and Government Affairs team, comprised in significant part by former congressional staff to House and Senate Leadership and to key health care committees, has successfully represented such industry clients as pharmaceutical manufacturers, device manufacturers, hospitals, health plans, and other health care providers in the legislative and regulatory arenas. Moreover, with veterans from key executive agencies (including General Counsels and Chief Counsels), we bring to bear our first-hand understanding of the dynamics within the White House, the Department of Health and Human Services and its agencies, including, FDA, CMS, and NIH, as well as the Departments of Labor and Treasury.

Representative Matters
- We successfully assisted several health care stakeholders during the Affordable Care Act debate, including pharmaceutical industry clients, the State of Louisiana, and the Commonwealth of Puerto Rico.
- We represent a large health care plan in implementing the Affordable Care Act.
- Our Public Policy and Government Affairs and Health Care practice developed a coordinated strategy to secure Medicare coverage of a new medical device.
- Using an integrated regulatory and legislative strategy, we successfully assisted Kos Pharmaceuticals to obtain Medicare Part D coverage for its previously excluded product.
- We assisted several pharmaceutical manufacturers in reinstating Medicaid coverage for products dropped from the program by the Centers for Medicare & Medicaid Services (CMS).
