With global privacy and data security experts based in London, Brussels, San Francisco, New York, and Washington, DC, Covington’s international privacy and data security practice is exceptional in its depth of knowledge and range of expertise. We are well-versed in the privacy and data security regimes in a host of jurisdictions worldwide, from the more established regimes of the European community to the more recent regimes found in the Asia-Pacific and Latin American regions.
Our international privacy team not only understands the compliance challenges associated with different regional and national privacy and data security laws, but appreciates how those challenges manifest themselves within specific industry contexts from country to country.
Representative Matters
- Worked with clients to develop and implement compliance strategies, including consent-based approaches and contractual controls, to facilitate transborder data flows and ensure compliance with laws restricting the international transfer of personally identifying information.
- Regularly assist clients in navigating complex and varied data privacy, telecommunications and labor laws arising from workplace monitoring.
- Conducted privacy “health checks” for clients to assess their compliance with privacy and data security laws, particularly those in the 27 Member States of the European Community; where appropriate, we have designed remediation programs that include, for example, filing notifications to local privacy regulators, fulfilling obligations to furnish notice, and ensuring compliance with local data security regulations.
- For a leading aerospace company, conducted an in-depth legal analysis of the application of privacy and data security laws in the United States, Europe, and Asia to new communications technology with potential consumer-facing components.
- Prepared a summary and analysis of the Australian privacy regime in connection with a proposed data sharing agreement involving personal information of Australian residents.
- Acquired an unparalleled understanding of the unique privacy issues confronting the pharmaceutical research, technology, and Internet industries; our work with the pharmaceutical research industry, for instance, includes developing model informed consent forms, Contract Research Organization (CRO) agreements, and clinical trial agreements, and advising more generally on the compliance issues arising from clinical research.
- Worked directly with, and appeared before national and regional privacy authorities, such as the European Commission, the EU Article 29 Working Party, and the Council of Europe, both to address emerging policy issues in the data privacy field, such as data retention, radio frequency identification (RFID), security breach legislation and biometrics, and to defend individual clients.
