Firm lawyers advise clients on legal issues raised by such new technologies as irradiation, DNA techniques, and other forms of genetic engineering (GE).  We have advised on such issues as the food additive status of GE foods; approval and use of GE new animal drugs; the need or advisability of premarket notification to FDA; the significance of possible allergic reactions to GE foods and ingredients; FDA authority to require labeling of GE foods; USDA/APHIS regulation of GE food plants under the Plant Protection Act; EPA regulation of GE food plants with pesticidal properties under FIFRA; EU requirements for labeling and approval of GE foods; and the labeling issues raised at the federal and state levels by FDA approval and dairy industry use of supplemental bovine somatotropin (bST).

Representative Matters

  • Represented several trade associations in litigation successfully challenging the validity of a Vermont compulsory bST labeling law on First Amendment and Commerce Clause grounds.
  • Represented leading food trade associations in connection with development of USDA and FDA regulations governing labeling, safety assessment and premarket notification of GE foods, and requirements for early food safety assessment of new GE food plants.
  • Counsel to Aventis in connection with the market withdrawal and regulation of Starlink corn by EPA and FDA.
