  • Representing Wachovia Bank, before the U.S. Supreme Court in Watters v. Wachovia Bank, N.A.regarding federal preemption of Michigan State officials’ efforts to regulate mortgage subsidiary of Wachovia Bank.
  • Represented Bank of America, and Wells Fargo Bank, in action before U.S. Court of Appeals for the Ninth Circuit resulting in federal preemption of ATM surcharge bans imposed by two municipalities.
  • Represented Wells Fargo Bank of Texas, Bank of America, and other banks in action before the U.S. Court of Appeals for the Fifth Circuit resulting in federal preemption of Texas statute barring check-cashing fees.
  • Representing National City Bank of Indiana in action before U.S. Court of Appeals for the Fourth Circuit resulting in federal preemption of Maryland State officials’ efforts to regulate mortgage subsidiaries of National City Bank.
