We advise and represent clients in regulatory and legislative matters, litigation, and transactional work throughout the United States and internationally. We frequently are asked to serve as advisors or advocates on projects presenting novel and complex issues, often of national and international importance.
For decades, we have represented companies and trade associations in rulemaking proceedings and appellate challenges to regulations, compliance advice, civil and criminal enforcement proceedings and citizen suits, and environmental aspects of business transactions. Our environmental lawyers, located in Washington, DC, New York, California and Brussels, have extensive experience with environmental regimes regulating contemporary water, air, toxic and hazardous substances and waste management, energy efficiency and eco-design, whether on the local, state, country or international level.
We assist clients in national and international stewardship issues, including the management of the European Union’s REACH, WEEE, RoHS, EuP programs and the developing laws and regimes in this area. As part of the Clean Energy and Climate industry group, we work in the developing area of climate control and we have participated actively during the legislative procedures leading to the adoption of the EU Emissions Trading Scheme and other carbon markets in the United States and around the world. With the rising emphasis on environmental stewardship, we will continue to see increased national and international focus on managing historical releases and environmental conditions. We have long-term experience with liability, contribution, remedy selection, and natural resource damage issues under the U.S. Superfund statute and analogous state and federal laws.
We provide advice and represent clients in disputes and litigation involving resource management and compliance with NEPA, CEQA, and like state statutes. For example, we have been active in litigation defending federal oil and gas leasing programs against NEPA and Coastal Zone Management Act challenges.
Our practice group brings acknowledged experts and seasoned practitioners. Our practitioners bring high-level government experience, such as the former Assistant Secretary of the Interior and former Chair of the Council on Environmental Quality, the former Staff Director and Chief Counsel of the House Select Committee on Energy Independence and Global Warming, and the former Chair of the Nuclear Regulatory Commission. We include lawyers listed in Chambers and Best Lawyers and other rating publications.
