Our lawyers, both here and in prior positions, have considerable experience representing suppliers and delivery companies before the state public service utility commissions and legislatures in connection with natural gas and electric deregulation, customer choice, and industry restructuring.  The range of issues with which we are knowledgeable and experienced includes: standard offer service/provider of last resort; reliability; creditworthiness; competitive billing; metering; universal service programs; customer education; and supplier licensing.  In addition, we are adept at effectively dealing with the often contentious and vexing issues surrounding federal, state, and regional jurisdiction.

Representative Matters

  • Commonwealth Edison in providing testimony and lobbying assistance before the Illinois General Assembly in connection with attempts to preclude the utility from recovering its purchased power costs.
  • Constellation Energy:
    • providing testimony and lobbying assistance before the Maryland General Assembly in connection with attempts to preclude Baltimore Gas & Electric Company (BGE) from recovering its purchased power costs.
    • leading the policy development, consensus building, and lobbying efforts to pass comprehensive electric industry restructuring legislation in Maryland.
    • orchestrating the process to gain all necessary state regulatory approvals to transfer approximately $2.5 billion in electric generation to an unregulated subsidiary.
    • directing BGE’s compliance and planning efforts in restructuring of the natural gas industry under FERC Order No. 436.
  • SDG&E in advising on the extensive proceedings concerning the restructuring of the California electric power industry.
  • Successfully negotiating with interstate gas pipelines, utilities, local distribution companies, state commissions, consumer advocates, and end-users in numerous FERC cases involving the full range of natural gas restructuring issues.
