We represent debtors, committees and creditors in seeking or contesting confirmation of plans of reorganization; debtors and creditors in claims litigation; members or former members of the boards of directors of companies as well as board committees in bankruptcy; and state agencies in sovereign immunity litigation. We counsel many clients facing allegations of voidable transfers of money or property and fraudulent conveyances under bankruptcy law and state law, and we have substantial experience in representing lenders facing claims of liability for interference with contractual relations and domination of control, including the “deepening insolvency” theory.
Covington has extensive and unique experience representing policyholders in bankruptcy cases to maximize and preserve their insurance assets. We are able to provide unparallel service to policyholders in bankruptcy because of our unique ability to bring to these engagements extensive experience and expertise in both insurance coverage and bankruptcy matters. We have served as special insurance counsel to debtors in some of the largest and most high-profile bankruptcy cases in the United States, including cases involving environmental, asbestos, and other mass-tort liability. Our engagements include representing Dow Corning in its recovery of over $1.5 billion of insurance coverage for its breast-implant liability, and serving as special insurance counsel to both Owens Corning and Armstrong World Industries in their Chapter 11 reorganizations.
