Our European Dispute Resolution Practice focuses on complex disputes raising issues of national and international commercial significance for our clients. We offer expertise in all forms of dispute resolution, including litigation before national and international courts, international arbitration, mediation and other forms of alternative dispute resolution as well as in connection with internal investigations. We generally act as lead counsel in such matters but also frequently play a coordinating or supervisory role with local counsel in multi-jurisdictional efforts.

International Arbitration We represent global clients before virtually all major international arbitral tribunals, including those formed under the auspices of the ICC, ICSID, LCIA, AAA, Netherlands Arbitration Institute, Stockholm Chamber of Commerce and Court of Arbitration for Sport.
Litigation in the National Courts We act as lead counsel on complex disputes on a wide variety of issues in the English, Belgian and German courts as well as giving advice to European clients on US proceedings and coordinating and supervising proceedings in many other national courts.
Product Liability Our product liability group has particularly strong expertise in the pharmaceuticals and medical devices and consumer products areas.
Litigation Before the Courts of the European Community Our innovative approach to litigation before the European Courts (ECJ and CFI) is focused on the distinct substantive, procedural, and strategic challenges in appellate litigation in Europe today.
Corporate Investigations We conduct worldwide investigations of alleged corporate fraud or misconduct, securities fraud, Foreign Corrupt Practices Act violations and other regulatory compliance matters globally.
Alternative Dispute Resolution We offer extensive experience in alternative dispute resolution, including mediation and the design and conduct of abbreviated mock trials as part of the settlement process.
Representative Matters
- We represent pharmaceutical companies on high value product liability claims, the details of which are confidential.
- We represented a major French bank in litigation in the United Kingdom in connection with an interest rate swap agreement before settling the matter on terms that were highly favourable to our client.
- On behalf of a group of corporate policyholders, we have successfully challenged proposed solvent schemes of arrangements for insurance carriers in the English High Court in London that aimed to extinguish cover for future claims by policyholders, starting with the case of The British Aviation Insurance Company Limited (“BAIC”), in which the Court refused to sanction the scheme.
- We regularly represent the Council of the European Union in anti-dumping and countervailing duty cases before the Court of the European Community. Recent prominent matters include the import of DRAMs from Korea and salmon from Norway.
- During the past couple of years, we have conducted internal investigations throughout Western and Eastern Europe for several of our life sciences clients as well as clients in other sectors. We also have represented such clients in discussions with law enforcement authorities, including the US Justice Department and Securities and Exchange Commission, focusing on possible violations of the US Foreign Corrupt Practices Act and Sarbanes Oxley. For a number of clients, we have undertaken in addition gap analyses, looking for policy deficiencies and/or policy implementation weaknesses posing unacceptable compliance risks.
