  • Advising clients regarding carrier pricing and marketing practices, inter-carrier agreements, and joint ventures between carriers and suppliers or customers;
  • Mergers, acquisitions, and pooling agreements;
  • Distribution arrangements, including advice regarding agreements with Global Distribution Systems (GDSs); and
  • Representation of clients in courts and tribunals and before the Department of Justice and the European Commission.

Representative Matters

  • Representation of Ryanair in numerous matters, including ongoing proceedings before the UK Office of Fair Trading and Competition Appeals Tribunal regarding its minority stake in Aer Lingus, ongoing proceedings before the General Court regarding the European Commission’s decision to oppose its acquisition of Aer Lingus, and in a challenge before the EU General Court against a state aid decision relating to Ryanair’s operations at Frankfurt Hahn airport.
  • Representation of IAG Travel & Logistics in connection with its arrangements with GDSs.
  • Representation of Expeditors International in a class action alleging a price-fixing conspiracy by freight forwarders and in previous investigations in the United States and Europe.
  • Representation of Union Pacific Railroad Company in multidistrict class action litigation alleging price-fixing of freight fuel surcharges in violation of antitrust laws and antitrust litigation alleging price fixing of fuel surcharges in violation of Section 1 of the Sherman Act, and other allegations in violation of Section 2 of the Sherman Act.
  • Representation of Expedia and TripAdvisor in connection with the Antitrust Division’s investigation of the Google/ITA Software transaction and investigations conducted by the Federal Trade Commission and the European Commission into Google’s conduct.
  • Representation of Expedia in a putative class action relating to online hotel bookings.
