Senior and junior firm lawyers expert in advertising, direct marketing, food and beverages, privacy, product safety, and other consumer law issues span all our offices in the United States and Europe.  Our lawyers have extensive experience with legislators and regulators – recently, for example, in representing clients before Congress, the FTC, and other federal and state bodies with respect to CAN-SPAM and commercial e-mail, software and e-commerce warranties, the enforceability of so-called “shrink-wrap licenses,” the Uniform Computer Information Transactions Act (UCITA), and the Telemarketing Sales Rule.  This experience enables us to help our clients develop efficient solutions to avoid potential pitfalls with respect to the increasing range of consumer law issues.

Representative Matters

  • Advice to numerous clients on how to comply with US, European, and other government regulations applicable to Internet sales, including the EU E-Commerce and Distant Selling Directives.
  • Advising retailers and financial institutions on the regulation of gift certificates, electronic gift cards, stored value cards, prepaid cards, and other payment mechanisms, as well as on compliance with consumer lending laws.
  • Advice to major media and publishing companies on requirements and best practices under federal and state law for direct marketing, including guidelines for consumer solicitations, renewal notices, special offers, and pricing.
  • Advising nationwide distributors of consumer products on compliance with warranty law.
  • Advice to providers of consumer services and goods on the regulation of sweepstakes, contests, games and other promotions.
