Mark Young advises clients on data privacy, security and intellectual property issues. He has particular expertise in legislative advocacy, regulatory compliance and online IP enforcement.

Mr. Young advises leading technology companies and consortia on a wide range of law reform efforts in Europe. This includes strategic advice and advocacy on EU and national initiatives, as well as references from Member State courts to the EU Court of Justice, relating to data privacy and retention, cybersecurity, copyright, trademarks, ecommerce, online liability, IP enforcement, and software related policy.

In addition to this strategic counseling, Mr. Young advises multinational internet-based companies and technology and pharmaceutical industry clients on regulatory compliance matters involving EU and UK data privacy and data retention laws. This includes providing practical guidance on compliance with European data privacy principles, international transfers of data, responding to data security breaches, use of exemptions and potential liability exposure. He also advises on associated information technology and ecommerce laws and regulations.

In the IP enforcement space, Mr. Young represents right owners in the sport, media and publishing industries, and helps coordinate a team of internet investigators who conduct global notice and takedown programs to combat internet piracy.

  • The Business Software Alliance and other technology industry clients on various EU legislative initiatives, including reviews of the Data Protection Framework, e-Commerce Directive, IP Enforcement Directive and the Telecommunications Framework, as well as proposals regarding cloud computing, cybersecurity, child online safety, electronic IDs and other technology related matters.
  • Facebook on EU data privacy compliance in relation to new features and products.
  • GlaxoSmithKline (GSK) on the development, implementation and authorization of its Binding Corporate Rules (BCRs) that allow GSK to transfer personal data from the European Economic Area (EEA) to affiliates located outside of the EEA in compliance with European data privacy rules.
  • Expedia and other leading internet-based companies on compliance aspects of their online services, and developing privacy policies and other data privacy compliance materials.
  • Several communication service providers in connection with electronic surveillance requests from law enforcement agencies.
  • eBay on transferring personal data internationally in the context of e-discovery.
  • Telefónica O2 UK on various data privacy and data retention matters.
  • A leading global cloud computing provider on complex cross-border regulatory issues, including data privacy, data retention, security, hosting liability and law enforcement access to data, as well as on specific outsourcing and security regulations in the financial, healthcare and public sectors.
  • Abbott, Pfizer and several other major pharmaceutical companies on compliance with European data protection rules relating to clinical trials, international transfers of data, outsourcing contracts and other matters.
  • A leading technology company in connection with efforts to prevent the sexual exploitation of children on the internet.
