Mike Wagner practices in the areas of government contracts and white collar defense and investigations.  Based in the firm’s Washington office, he has represented clients in the defense and aerospace, pharmaceutical, energy, and mass media industries.

Mr. Wagner counsels government contractors on issues arising at all stages of the public procurement process, including contract disputes and administration, corporate acquisitions, False Claims Act compliance, suspension and debarment risks, and bid protest litigation.

Mr. Wagner also assists corporate clients in achieving the efficient resolution of government and internal investigations into allegations of fraud and corruption.  He has particular experience preparing for and conducting witness interviews, managing complex e-Discovery projects, and developing and executing legal strategies.

Representative Matters

Government Contracts

  • Secured $12.8 million dollar recovery for Dubai-based contractor following termination for convenience by U.S. Army Corps of Engineers.
  • Representing leading defense contractor in post-award bid protest proceedings before the Government Accountability Office.
  • Assisting private equity firm with government contracts due diligence review in connection with proposed M&A transaction.
  • Advising pharmaceutical company on rights and obligations under vaccine contracts with the U.S. Department of Health and Human Services.
  • Advised aerospace contractor on potential suspension and debarment risks related to proposed corporate acquisition.

White Collar Defense & Investigations
  • Representing CEO of publicly held company in internal investigation arising out of earnings restatement.
  • Representing Fortune 500 pharmaceutical company in internal investigation into allegations of off-label marketing activities.
  • Counseling engineering and applied technology company on anti-corruption issues related to proposed teaming arrangement in Saudi Arabia.
  • Successfully represented corporate client in SEC civil investigation into suspected securities violations.
