Michael Rosenthal is chair of the firm's Transportation Practice Group and a member of the litigation and antitrust practice groups. He represents clients before federal administrative agencies and in federal and state courts, and he advises them on transportation and competition law.
In the transportation arena, he has represented railroad clients in a broad array of proceedings before the Surface Transportation Board, including railroad acquisition and control transactions, industry-wide rulemakings, rate reasonableness challenges, and abandonment proceedings. He has also represented transportation clients in federal and state court proceedings, in arbitration proceedings, and before the Federal Maritime Commission. In the antitrust arena, he has represented and advised clients in the transportation industry and other industries in connection with mergers, joint ventures, government investigations, and private litigation matters.
Representative Matters
- Represented Union Pacific Railroad Company in obtaining dismissal of a rate reasonableness complaint before the Surface Transportation Board and as an intervenor in support of the agency’s decision in the U.S. Court of Appeals for the District of Columbia Circuit.
- Represented TTX Company in obtaining reauthorization of its rail flatcar pooling authority and antitrust immunity before the Surface Transportation Board.
- Represented the Maryland Port Administration in persuading the Federal Maritime Commission to dismiss a complaint alleging that the Port Administration had violated the Shipping Act by offering discriminatory lease terms.
- Advised motor carrier associations regarding changes to procedures following termination of antitrust immunity.
- Represented Union Pacific Railroad Company in winning dismissal of a federal court complaint challenging the structure of the railroad’s coal tariff.
