Marie Lavalleye is a member of the intellectual property group, specializing in trademark, copyright, false advertising, rights of publicity, and Internet-related matters.

Ms. Lavalleye has a broad-based trademark and copyright counseling practice.  In addition to advising clients on U.S. and foreign trademark selection, clearance, registration and enforcement issues and on U.S. copyright protection and enforcement matters, Ms. Lavalleye has significant experience in negotiating and drafting trademark and copyright license, assignment, security and other IP-related agreements and in conducting and coordinating IP due diligence reviews in connection with corporate transactions such as mergers and acquisitions, corporate financing and debt restructuring.

Ms. Lavalleye represents clients in opposition and cancellation proceedings before the United States Patent and Trademark Office’s Trademark Trial and Appeal Board and in arbitration proceedings involving Internet domain names.  Ms. Lavalleye’s practice also includes advising clients on trademark counterfeit and gray market enforcement matters, developing and implementing strategies for barring importation of counterfeit and gray market goods, and on trademark dilution, rights of publicity and false or misleading advertising issues.

Ms. Lavalleye represents clients in a broad range of industries, including the broadcasting, commodities, consumer products, cosmetics, dietary supplements, financial, pharmaceutical, quick service restaurant, software, spirits, sports and entertainment, and telecommunications industries.

Ms. Lavalleye serves on the firm’s Retirement Plan Committee.

Representative Matters

  • Advising on all intellectual property and licensing aspects of multi-million television, Internet and new media broadcasting deals for the National Football League, Major League Baseball and NASCAR.
  • Working with tax experts in developing and implementing a global strategy for protecting, licensing and enforcing an international conglomerate’s global brand.
  • Developing and implementing a brand protection and domain name enforcement strategy for a leading telecommunications company.
  • Representing a global manufacturer and seller of spirits in administrative proceedings before the U.S. Patent and Trademark Office’s Trademark Trial and Appeal Board.
  • Conducting and managing the IP due diligence relating to Goodyear’s restructuring of its multimillion dollar bank credit and accounts receivables facilities.

  • Representing the NFL Alumni, Inc. in connection an agreement with a developer in Texas for the development of a sports-themed recreational residential community.
  • Trademark counsel to the Coordinating Counsel for International Universities, a not-for-profit organization formed by leading educators, former governmental officials and former ambassadors, whose mission is to design, establish and administer universities based on the American model of higher education in China, Afghanistan and other foreign countries.
  • Trademark and copyright counsel to the SNAP Foundation, Inc., a not-for-profit organization that has put in place educational programs directed to school-aged children that promote self-esteem, self-confidence, and social and personal growth by focusing on positive life choices through the use of creative writing, artistic expression, photography and computer-aided research.
  • Trademark and copyright counsel to the Cosmetic, Toiletry and Fragrance Association Foundation and its Look Good Feel Better program providing hair, make-up and skin care techniques for cancer patients and cosmetologists who provide such services to cancer patients.
