Mark Gimbel is a litigation partner based in New York and a vice-chair of the firm’s litigation practice.  His practice focuses on complex business litigation, including securities actions, commercial torts, corporate control litigation, and partnership disputes.  Mr. Gimbel has tried cases in state and federal court and before arbitral tribunals including the ICC and the NASD.

Representative Matters

  • Representation of Forest Laboratories, Inc. in shareholder class action litigation arising out of its $1.3 billion acquisition of Clinical Data, Inc.
  • Representation of Del Monte Corporation in shareholder class action litigation arising out of the company’s $5.3 billion acquisition by private equity firms.
  • Representation of SandRidge Energy, Inc. in nine putative shareholder class action lawsuits seeking to enjoin SandRidge’s $1.6 billion acquisition of Arena Resources, Inc.
  • Representation of a large international bank and its US subsidiary in a dispute concerning assets frozen pursuant to US sanctions regulations.
  • Representation of a Fortune 500 bank in a purchase price dispute concerning the sale of its subprime lending subsidiary.
  • Representation of Sterling Financial Corporation and its Board of Directors in opposing a putative shareholder derivative action to enjoin a planned merger with The PNC Financial Services Group, Inc.
