Matthew S. DelNero is a partner in the firm’s Washington office.  He serves as a trusted advisor to innovators and investors in the telecommunications, technology and media sectors—advising clients in policy development, regulatory compliance, and commercial transactions, among other settings.

Mr. DelNero routinely counsels clients in legal and regulatory matters that bring to bear his expertise in spectrum policy, privacy and data protection, program and network distribution, music and other content licensing, and regulations governing the ownership of telecommunications and media properties.

Chambers USA, Legal 500 USA, and other legal publications have recognized Mr. DelNero as a leading communications and media lawyer.  He recently was appointed to serve as an Adjunct Professor at the George Mason University School of Law, teaching a course on telecommunications law, policy and regulation.

Within the firm, Mr. DelNero serves on the leadership team of the Media, Internet & Technology industry group and co-chairs the LGBT Subcommittee of the firm’s Diversity Committee.

Representative Matters

Regulatory Compliance & Policy Development

  • Counsel to the Public Broadcasting Service (PBS) in major proceedings before the FCC, including the rulemaking to establish rules for a broadcast incentive auction.
  • Represent a national higher education association before the U.S. Copyright Royalty Board, to determine royalties paid by over 700 college radio stations to ASCAP, BMI and SESAC.
  • Defend manufacturers and distributors of Part 15 devices in enforcement proceedings and inquiries before the FCC.

Video Distribution
  
  • Represent and counsel television broadcast owners and cable networks in retransmission consent and network affiliation negotiations with cable, satellite and IPTV companies.
  • Author amicus brief on behalf of broadcast trade associations challenging unauthorized streaming of broadcast signals in the WNET v. Aereo litigation.
  • Testified before the U.S. Copyright Office on the future of the compulsory copyrights for cable and satellite retransmissions of broadcast programming.
      

Privacy & Data Security

  • Counsel cloud computing providers on international data transfer standards.
  • Advise multinational companies on compliance with new privacy and data security laws in Mexico, Colombia, Peru, Costa Rica and other emerging markets.
  • Assist software and online service providers serving the educational market in compliance with FERPA, COPPA and other educational and children’s privacy standards.
      

Commercial Transactions

  • Represent major telecommunications provider in all aspects of the recent sale of its 700 MHz and AWS-1 wireless licenses.
  • Serve as principal telecommunications counsel to the largest holder of debt in NextWave Wireless, in connection with NextWave’s $600 million sale of WCS spectrum to AT&T.
  • Advise Berkshire Partners on federal, state and local regulatory approvals for its $2 billion acquisition of Lightower Fiber Networks and Sidera Networks.
