Lindsey Tonsager is an associate in the firm’s Washington, DC office, where she practices in the areas of communications and media, intellectual property, and privacy & data security law.

Ms. Tonsager represents clients in rulemaking and adjudicatory proceedings before the Federal Communications Commission, the Federal Trade Commission, and the Copyright Royalty Board.  She has advised clients on a broad range of regulatory issues, including cable and satellite carriage and retransmission consent rules, spectrum policy, network management restrictions, and the laws governing the collection of information from children online, behavioral advertising, and online marketing.

Ms. Tonsager also represents clients in commercial transactions, including the licensing and protection of intellectual property, retransmission consent agreements, and network affiliation contracts.

With respect to her legislative work, Ms. Tonsager assists clients in their efforts to shape federal and state policy in the areas of communications and media, copyright, and privacy law.  Her experience in each of these areas allows her to advise clients on the range of issues that arise as these disciplines increasingly overlap.

Representative Matters

  • Counseled pharmaceutical companies on how to formulate online marketing campaigns that comply with the Controlling the Assault of Non-Solicited Pornography and Marketing (CAN-SPAM) Act and implementing regulations.
  • Counseled technology and media companies on the FTC’s principles on behavioral advertising and industry guidelines for online advertising.
  • Represented the Public Broadcasting Service in negotiations and administrative proceedings relating to the distribution of statutory copyright royalties collected by the U.S. Copyright Office.
  • Represented a noncommercial broadcast television station in negotiations for carriage with a national cable operator.
  • Advised operators of general audience and child-directed websites on how to comply with the Children’s Online Privacy Protection Act and corresponding FTC regulations.
  • Represented a major broadcast industry trade association in proceedings before the FCC concerning rules for new uses of the broadcast spectrum.
