Because client needs are typically best served by negotiated solutions, our lawyers make extensive use of mediation, early case evaluation, conciliation, and other non-binding ADR techniques, in both US and foreign proceedings. We have obtained billions of dollars of recoveries for our clients who are claimants through non-binding ADR techniques, and we have used the same techniques to secure early and sensible business solutions for our defense clients. We appear frequently before many of the world's most accomplished mediators.
Our results in the mediation arena are typically confidential, but our work has covered the full range of techniques and a broad spectrum of subject matters. Many of our lawyers are effective mediators in their own right, and several serve on judicial mediation panels or on the AAA, CPR, or ICSID rosters of mediators or conciliators. Others have been appointed by major corporations to serve on internal dispute-resolution committees of various kinds. One of our partners was recently honored by the Harvard Program on Negotiation with its Great Negotiator Award.
We consider and pursue non-binding ADR techniques whenever they seem to be in the best interests of our clients - whether on an ad hoc basis, with the assistance of formal institutions or courts, or under established mediation protocols.
