Kim Strosnider advises companies on the application of international trade controls, including export controls, sanctions, and antiboycott laws and regulations.  She currently serves as vice-chair in the firm’s International practice group, focusing on trade controls, and is co-chair of the ABA’s Aerospace and Defense Industries Committee.

Ms. Strosnider counsels clients on US export controls administered by the Departments of State, Commerce, and Energy and the Nuclear Regulatory Commission; economic sanctions programs administered by the Treasury Department; import and licensing requirements imposed by the Bureau of Alcohol, Tobacco, Firearms and Explosives; and compliance with US antiboycott laws.  She has counseled companies in the manufacturing, aerospace, defense, energy, nuclear, pharmaceutical, and medical device sectors, among others.

Ms. Strosnider also has represented clients in state and federal court litigation and before arbitration panels.

Representative Matters

  • Advise clients on the navigation of international trade control compliance requirements in their day-to-day business activities, including resolution of complex compliance, licensing, and product jurisdiction/classification issues.
  • Develop and assist clients with the implementation of compliance initiatives (including policies, procedures, and manuals) and provide international trade controls training.
  • Counsel clients on the application of US trade controls to business activities in emerging markets such as China.
  • Conduct internal investigations into international trade control violations and assist clients in enforcement actions. Capabilities in this area include assisting clients in preparing voluntary self-disclosures to the Department of State, Directorate of Defense Trade Controls (DDTC) and the Department of Commerce, Bureau of Industry and Security (BIS) and Office of Antiboycott Compliance (OAC); responding to agency inquiries; and helping clients design and implement corrective compliance measures in the wake of disclosures and enforcement actions.
  • Advise clients on the drafting/preparation of license applications, technical assistance and manufacturing license agreements, commodity jurisdiction and commodity classification ruling requests, and registration with DDTC.
  • Represent clients in mergers and acquisitions activities, including conducting and responding to trade controls due diligence, crafting representations and warranties and other contractual provisions related to trade controls compliance, and filing M&A-related notifications with the State Department.
  • Assist companies in navigating Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) regulatory requirements, including obtaining importer registrations and permits and Federal Firearms Licenses (FFLs).
  • Counsel clients in the medical-device sector on the application of US sanctions and humanitarian licensing programs, including the Trade Sanctions Reform and Export Enhancement Act (TSRA).
