Keith Noreika, a partner whose practice focuses on bank regulatory, general and appellate litigation matters, represents a variety of financial institutions before government agencies and in litigation in various district and appellate courts.  His cases representing financial institutions have included federal preemption challenges to state and local laws, as well as challenges to administrative regulations issued by federal banking agencies. 

Representative Matters

  • Represented, in the U.S. Supreme Court, the U.S. Courts of Appeals, and the U.S. District Courts, several large national banks in their federal preemption challenges to states’ assertions of regulatory and supervisory authority over the activities of national banks’ operating subsidiaries.
  • Represented in the U.S. Court of Appeals for the Ninth Circuit and in the U.S. District Court for the Eastern District of California, several large financial services trade organizations in their federal preemption challenges to a California privacy law restricting customer information sharing between financial institutions and their affiliates.
  • Represented several large national banks in the U.S. Courts of Appeals and the U.S. District Courts in their federal preemption challenges to state and local laws banning those banks from charging ATM and check-cashing fees.

Pro Bono

  • Represented the National Association of Scholars in the U.S. Supreme Court, the U.S. Court of Appeals for the Sixth Circuit, and the U.S. District Court for the Eastern District of Michigan, supporting students’ challenges the University of Michigan’s discriminatory admissions policies.
  • Represented, in the U.S. Court of Appeals for the Third Circuit, prisoners seeking to overturn civil forfeiture decrees.
  • Represented, in the U.S. Court of Appeals for the D.C. Circuit, student and parents seeking to obtain compensatory education award under the Individuals with Disabilities in Education Act.
