John Vine is the senior member, and the former head, of our Employee Benefits Group.  His practice has concentrated on employee compensation and benefits for over 35 years.  His practice covers incentive compensation, deferred compensation, stock option, and fringe benefit programs, as well as pension, § 401(k), employee stock ownership and stock purchase plans, severance programs, and health and welfare plans.

Mr. Vine has served for over 25 years as counsel to The ERISA Industry Committee (“ERIC”), an association of over 100 of the nation’s largest employers.  He has represented ERIC and corporate clients before the Treasury Department, the Internal Revenue Service, the Department of Labor, the Pension Benefit Guaranty Corporation, the Equal Employment Opportunity Commission, and the Congress on a wide variety of employee compensation and benefit issues.  Mr. Vine has testified in hearings held by House and Senate committees and by the Treasury and Labor Departments, and he has litigated employee benefit cases in U.S. District Courts, the U.S. Tax Court, U.S. Courts of Appeal, and the U.S. Supreme Court.  Mr. Vine also serves as outside ERISA counsel to Fiduciary Counselors, Inc.

Representative Matters

  • Represented corporate clients in investigations and audits conducted by the U.S. Department of Labor and the Internal Revenue Service.
  • On behalf of The ERISA Industry Committee, drafted written comments and testified at a hearing held by the Treasury Department and the Internal Revenue Service regarding proposed regulations governing nonqualified deferred compensation under Internal Revenue Code § 409A.
  • Testified before the Subcommittee on Employer-Employee Relations of the House Committee on Education and the Workforce on investments by defined contribution plans in employer stock.
