Joseph Kresse practices in the firm’s Pharmaceutical Litigation & Investigations and White Collar Practice groups.  His work also extends to firm’s broader Litigation & Dispute Resolution area.  Mr. Kresse has significant experience representing corporate and trade association clients in civil and criminal investigations and complex civil litigation involving product liability, false claims, and fraud actions.  His experience spans issues arising in all phases of litigation, from pre-complaint investigations through post-trial briefing, and includes significant experience in resolving complicated discovery matters.  Mr. Kresse is also experienced in conducting internal investigations and related client counseling.  He has advised and worked closely with clients on document retention and management policies.  Mr. Kresse also has extensive experience in resolving e-discovery issues and advising and assisting clients in managing the related preservation and collection efforts and associated costs.

Representative Matters

  • Represented pharmaceutical clients in connection with a government investigations of alleged violations of current good manufacturing practice (cGMPs), off-label promotion of prescription drugs and anti-kickback statute compliance.
  • Defense of trade association client in civil RICO, products liability and class action cases in multiple federal and state jurisdictions.
  • Advised multinational clients on emerging legislative, regulatory, and compliance matters.

  •  Functional finance and accounting responsibilities within a corporate start-up venture.
