The firm’s transportation regulatory practice has a rich history of breadth and depth of expertise and experience.  We have handled a broad range of regulatory matters cutting across all modes of transportation.  We are also able to enhance our regulatory capabilities with similarly broad and deep governmental affairs and litigation expertise.

Our lawyers regularly represent transportation clients in a wide array of regulatory matters.  We have represented a number of large and small railroads, and a railroad trade association, in proceedings before the Surface Transportation Board (the successor to the Interstate Commerce Commission) and the Department of Transportation.  We have provided counsel to airlines and computer reservation systems in proceedings before the Department of Transportation.  We have represented a maritime interest before the Federal Maritime Commission.  And we have assisted passenger and freight railroads with corporate transactions that involve securing the necessary private financing and regulatory approval.  Linda Morgan, the head of the firm’s Transportation practice group, was formerly Chairman of the Surface Transportation Board (and the Interstate Commerce Committee before that) and General Counsel of the Senate Committee on Commerce, Science and Transportation, and brings an impressive breadth and depth of experience and expertise in the transportation regulatory and legislative arena.

Representative Matters

  • We continue to represent Union Pacific Railroad Company in a broad range of economic regulatory matters before the Surface Transportation Board, including rate cases and mergers.
  • We have represented other large and small railroads in regulatory proceedings before the Surface Transportation Board.
  • We continue to represent the Association of American Railroads in economic regulatory matters before the Surface Transportation Board and in safety and economic regulatory matters pertaining to the transportation of hazardous materials.
  • We represent a group of investors proposing to build a high-speed passenger rail line between Las Vegas, Nevada and Southern California.
  • We have provided counsel to a trucking company and to various drug companies in their efforts to ensure compliance with motor carrier safety regulations.
